The present Writ Petition is filed to declare the action of Respondent No. 3 in not considering the Petitioner’s representation seeking a change of venue for the oral enquiry pursuant to Memorandum Vide C.No.15/AC/SPF/UCIL/ OE/2025/D.No.606, dated 28.10.2025, issued by Respondent No.6, and the appointment of an independent and impartial Enquiry Officer as illegal and arbitrary. 2. The Petitioner was issued a Charge Sheet regarding the allegations of misconduct. Pursuant thereto, Respondent No. 7 was said to have been appointed as Enquiry Officer and a Notice was issued by Respondent No. 7 calling upon the Petitioner to attend the enquiry at Giddalur Police Station. It is alleged that the Respondent No. 7 has threatened the Petitioner that an adverse Enquiry Report would be submitted in a telephone call. Hence, the present writ petition is filed for change of venue of the Enquiry and the Enquiry Officer. 3. Heard the respective counsel. 3 4. As regards the venue of the enquiry, this Court is not inclined to interfere to that extent, as it is the prerogative of the Enquiry Officer. As regards the neutrality of the Enquiry Officer/Respondent No. 7, though no dates of alleged telephone calls between the Petitioner and the Respondent No. 7 are mentioned, it would be appropriate for the Petitioner to submit a representation to the Disciplinary Authority. 5. Accordingly, the Writ Petition is disposed of with the following directions: i) The Petitioner is given liberty to submit a representation to the Respondent No.3/Disciplinary Authority within a period of two weeks regarding the allegations against the Respondent No.7/Enquiry Officer. ii) On receipt of such Representation, the Respondent No.3 shall examine the same and take an appropriate decision thereon within a period of two weeks thereafter. iii) There shall be no order as to costs.
