ORDER ON BOARD 03.12.2025
1. Petitioner has filed this writ petition seeking following reliefs:-
“10.1 This Hon’ble Court may be pleased to direct the respondents to produce entire record pertaining to the petitioner’s case. 10.2 This Hon’ble Court may be pleased to direct the respondent no. 2 to carry out a lawful process of demarcation with regard to Khasra No. 321/16 land of petitioner no. 1, Khasra No. 321/15 land of petitioner no. 2 and Khasra No. 321/14 land of petitioner no. 3 and necessary steps may be taken in accordance with law. 10.3 That, this Hon’ble Court may kindly direct the respondents to decide the representation [P/3] filed by the petitioners. 10.4 Any other relief in the discretion of this Hon’ble Court.”

Learned counsel for both the respective parties submits that earlier some persons have approached this Court by filing a writ petition bearing WPC No. 5220/2025 which was disposed of directing respondent therein to consider and take decision on pending
3 representation submitted by petitioners therein after giving proper opportunity of hearing to all the persons.

Learned counsel for petitioner submits that respondent no. 2 - corporation has issued a notice to petitioner no. 3 dated 21.08.2025 alleging that petitioner is in possession of part of Khasra No. 321/9 which is not correct whereas petitioner is in possession of Khasra No. 321/14. The notice Annexure P-2 is issued to petitioner no. 3 without demarcating the area so as to arrive at the conclusion that petitioner was in unlawful possession of Khasra No. 321/9. After issuance of notice, petitioner has already submitted representation before respondents on 07.11.2025. However, no decision has been taken.

Learned counsel for respondent no. 2 and 3 submits that representation submitted by the petitioners will be considered in accordance with law.
5. I have heard learned counsel for the respective parties and perused the documents enclosed along with this writ petition.

In view of submission made by counsel for the respondent no. 2 and 3 nothing remains in this writ petition for adjudication, accordingly, this writ petition is disposed of in view of submission made by counsel for respondent no. 2 and 3, directing them to take decision on representation in accordance with law expeditiously, on its own merits, preferably within a period of three months from the date of receipt of copy of this Order.
