ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to pleased to issue a Writ, order or direction, more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondent Authorities in not registering an FIR on disclosure of commission of cognizable offences based on the Complaint dated 26-06-2023 as illegal, arbitrary, violative of principles of natural justice and as such violative of Articles 14, 21 and 327 of the Constitution of India and consequently to direct the Respondent Authorities to register an FIR in furtherance of the Complaint dated 26/06/2023 and to conduct an impartial investigation and pass…”
2. None represented for the petitioners. The present Writ Petition is filed seeking a direction to the respondent police to register the FIR basing on the petitioner’s complaint dated 26.06.2023. 03. Sri V. Farooq, learned Assistant Government Pleader for Home, on written instructions, submitted that based on the complaint lodged by one Sri Ramakrishna, Crime No.211 of 2023 was registered for the offences under Sections 341, 506 r/w 34 IPC and Section 3(1)(r)(s) of the SC/ST (Prevention of Atrocities) Act, 1989 at Hindupur I Town Police Station against the accused persons namely D.R.G. Anand, Srikanth and Sampath, and the investigation is in progress. It is further submitted that the petitioner has also given another
complaint in respect of the same incident, and since a crime has already been registered, the petitioner has been shown as a witness in the said case. As multiple complaints relate to the same occurrence, no separate FIR has been registered again. 4. In view of the submissions made by the learned Assistant Government Pleader, and as a crime has already been registered and is under investigation pertaining to the very same incident referred by the petitioners, no further orders are required in the matter. 5. Recording the submissions, this Writ Petition is accordingly disposed of. However, the petitioners are liberty to place any further material before the investigating officer, if any, in accordance with law during the course of investigation. There shall be no order as to costs.
