The learned counsel for the petitioners fairly states that the proceedings under Section 125 of the Code of Criminal Procedure ought to have filed at Mumbai, but it was wrongly filed at Akola. He, therefore, without agitating the present petition, wants direction to the learned trial Court to return back his application to file the same before the appropriate Court at Mumbai. 2. In that view of the matter, the petition is disposed of with direction to the learned trial Court to return back the application of the petitioner to file the same before the appropriate Court at Mumbai. 3. The point as regards the entitlement of the petitioner for maintenance from the date of the application filed at Akola is kept open. The Criminal Writ Petition is disposed of accordingly. (ANIL S.
