2025:UHC:5281-DB SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGE’S ORDERS
WPSB No.122 of 2020 Hon’ble Manoj Kumar Tiwari, J. Hon’ble Subhash Upadhyay, J.
Mr. Bhagwat Mehra, learned counsel for the petitioner.
2. Mr. Devendra Singh Bohra, learned Standing counsel for the State.
3. Petitioners were engaged on contract in National Health Mission from time to time. Their last engagement was valid till
31.03.2020. The Additional Mission Director (NHM) issued a letter on 30.04.2020 stating that engagement of certain contract employees, including petitioners, is not to be renewed during financial year 2020-21. Feeling aggrieved by said letter dated 30.04.2020 petitioner has approached this Court.
4. Since petitioners were engaged on contract and the competent authority refused to renew contract because of their unsatisfactory performance, therefore, we do not find any reason to interfere with the communication impugned in the writ petition.
5. Law is well settled that a contractual employee does not hold lien on a post. It is not a case where petitioners are disengaged before expiry of their term of engagement. Even otherwise also, petitioners were engaged in National Health Mission, which
2025:UHC:5281-DB is a project sponsored by Central Government, where persons are engaged on contract, as per exigencies of work.
6. In view of the above, writ petition fails and is hereby dismissed.
