JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 08-08-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. Petitioner seeks regular bail in connection with Nadi P. S. Case No. 156 of 2024 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. 3. As per the prosecution case, 136 liters of illicit liquor were recovered from co-accused Manish Kumar. 4. Learned counsel for the petitioner submits that he is innocent and has committed no offence. No incriminating material has been recovered from conscious possession of the petitioner. The name of the petitioner has transpired in this case on the basis of confessional statement of co-accused Manish Kumar, who has been granted privilege of bail by a co-ordinate Patna High Court CR. MISC. No.42094 of 2025(2) dt.08-08-2025 2/2 Bench of this Court in Cr. Misc. No. 46675 of 2024 vide order dated 18.09.2024. Petitioner is in custody since 10.05.2025. 5. Learned A.P.P. for the State vehemently opposes the bail application. 6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of Excise, Patna City, District Patna in connection with Nadi P.
