T.NARAYANA AGED ABOUT 37 YEARS, OCC-AGRICULTURE ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the respondents No.2 to 5 in providing Police aid to the persons and property in extant of Ac.2.50 Cents in Sy.No.312/2B, in Purandlapalle Village, Ramasamudram Mandal, Annamaiah District, from the respondents No.6 to 14 in pursuance of the Decree, dated 08-01-2024 made in O.S.No.262 of 2022 on the file of the Principal Junior Civil Judge at Punganur, Chittoor District, as arbitrary, illegal, abdication of the statutory duty cast on them, contrary to the well settled legal position apart from being voilative of the fundamental and Constitutional rights guaranteed to petitioner under Articles 14, 19,21 and 300-A of the Constitution of India and consequently direct the respondents No.2 to 5 to provide the Police aid to person and properties in an extant of Ac.2.50 Cents in Sy.No.312/2B, in Purandlapalle Village, Ramasamudram Mandal, Annamaiah District, from the respondents No.6 to 14 in pursuance of the Decree, dated 08-01-2024 made in O.S.No.262 of 2022 on the file of the Principal Junior Civil Judge at Punganur, Chittoor District, and pass Counsel for the Petitioner: 1. GP FOR HOME 3 The Court made the following: ORDER: The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief: “.... to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the respondents No.2 to 5 in providing Police aid to the persons and property in extant of Ac.2.50 Cents in Sy.No.312/2B, in Purandlapalle Village, Ramasamudram Mandal, Annamaiah District, from the respondents No.6 to 14 in pursuance of the Decree, dated 08.01.2024 made in O.S.No.262 of 2022 on the file of the Principal Junior Civil Judge at Punganur, Chittoor District, as arbitrary, illegal, abdication of the statutory duty cast on them, contrary to the well settled legal position apart from being violative of the fundamental and Constitutional rights guaranteed to petitioner under Articles 14, 19,21 and 300-A of the Constitution of India and consequently direct the respondents No.2 to 5 to provide the Police aid to person and properties in an extant of Ac.2.50 Cents in Sy.No.312/2B, in Purandlapalle Village, Ramasamudram Mandal, Annamaiah District, from the respondents No.6 to 14 in pursuance of the Decree, dated 08.01.2024 made in O.S.No.262 of 2022 on the file of the Principal Junior Civil Judge at Punganur, Chittoor District, and pass ...” Heard learned counsel for the Petitioner and learned Government Pleader for Home appearing for respondent State. None represented for respondents 6 to 14. Perused the material on record. Learned counsel for the Petitioner would submit that notices sent to unofficial respondents 6 to 14 were returned as „refused‟. As per the office endorsement, notices sent to respondents 6 to 14 were returned as „refused‟. Learned Assistant Government Pleader for Home would submit that respondent Police have received representation from the petitioner. Since the matter is civil in nature, unless there is any judicial order, respondent Police 4 cannot be provided police aid to protect the property of the Petitioner and that Police have recorded the statement of the petitioner and closed the petition. Vide Judgment dated 08.01.2024, in OS No.262 of 2022 on the file of the Court of Principal Junior Civil Judge, Punganur, Chittoor District, the suit was decreed in favour of the Petitioner and against the unofficial respondents restraining them by way of permanent injunction from interfering in the petitioner‟s possession and enjoyment of the suit schedule property. In that view of the matter, it is apposite to direct the petitioner to make a fresh representation to the Police. On presentation of such representation, police are directed to take appropriate steps to protect the interest of the petitioner over the subject property by virtue of the Judgment dated 08.01.2024, in OS No.262 of 2022 on the file of the Court of Principal Junior Civil Judge, Punganur, Chittoor District.
