IN THE HIGH COURT OF ORISSA AT CUTTACK CONTC No.5596 of 2022 Dhiren Kumar Pani and Others …. Petitioners None -versus- Satyananda Patra, Sub Registrar, Dhamnagar …. Opp. Party/ Contemner Mr.Sabita Ranjan Pattnaik, (Additional Government Advocate) CORAM: JUSTICE K.R. MOHAPATRA ORDER Order No. 11.07.2025 01. 1. This matter is taken up through hybrid mode. 2. None appears for the Petitioners at the time of call. 3. This CONTC has been filed alleging noncompliance of order dated 20.06.2022 by which W.P.(C) No.9129 of 2022 is disposed of with the following direction:- “xxx xxx xxx xxx. Taking into consideration the submissions made by learned counsel for the parties and the requirement under Section 35 of the Act read with Rules 63 and 64 of the Rules, this Court is of the considered opinion that the concerned Sub-Registrar is obliged under law to make an inquiry as stated above before registration of the deed, if any, executed by Opposite Party No.4, if an application/objection is filed to that effect. Mr.Mohanty, learned counsel for the Petitioners undertakes to produce the certified copy of this order before the Sub-Registrar, Dhamnagar to do the needful in accordance with law.” 4. Mr.Pattnaik, learned Additional Government Advocate, on instruction, submits that no sale deed executed by Opposite Party No.4, namely, Sri Braja Sunder Pani is received till date. Thus, question of raising objection to execution of such sale deed does not arise. 5. In view of the above, this Court feels that no contempt is made out, as alleged. 6. Accordingly, the CONTC is dropped. (K.R. Mohapatra) Judge Himansu
