and violative of Articles 14, 25, and 26 of the Constitution of India consequentially, direct the Respondents not to proceed with the constitution of the Trust Board for the subject Temple i.e. the 5th respondent Temple under the impugned Notification in Rc.No.D1/COE- 14021(31)/3/2025-13, dated 07.08.2025 until the successful completion of the ongoing Maha Kumbabhishekam and temple renovation works and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents not to proceed with the constitution of the Trust Board for the subject Temple i.e. the 5th respondent Temple under the impugned Notification in Rc.No.D1/COE- 14021(31)/3/2025-13, dated 07.08.2025 until the successful completion of the ongoing Maha Kumbabhishekam and temple renovation works pending disposal of the above writ petition and to pass Counsel for the Petitioner(S):

The Court made the following:
ORDER:
Heard Sri P.Vasu Sekhar, learned counsel for the petitioners, Sri G.Naga Bhushanam, learned Assistant Government Pleader for Endowments appearing for the 1st to 4th respondents and Sri T.Venu Gopal, learned Standing Counsel appearing for the 5th respondent.
2. The instant writ petition is filed challenging the action of the 3rd respondent in not considering the request of the petitioners dated 26.08.2025 to postpone the constitution of the Trust Board.
3. It is contended that the 3rd respondent vide proceedings dated 07.08.2025, invited the applications for Trusteeship in the prescribed proforma vide FORM-II for constituting the Trust Board.
4. The contention of the petitioners is that the Sri Kasivisweswara Swamy Temple, Palamaner (T&M), Chittoor District, is being renovated with the donations made by the devotees. In view of the Maha Kumbhabhishekam, if the trust board is constituted, having made substantial contributions towards the renovation of the temple, the petitioners will not be able to participate in the religious functions and ceremonies of the temple. Having regard to the same, the petitioners made a representation before the respondents seeking extension of postponement of the constitution of the Trust Board. Since no orders have been passed on their representation, the instant writ petition has been filed. The present writ petition was filed on 28.08.2025. However, today

i.e., on 12.09.2025, when the matter is taken up for consideration, Assistant Commissioner of Endowments Department, on the basis of written instructions dated 09.09.2025, has submitted that pursuant to the notification,13 persons have applied for trusteeship of the subject temple.
5. Learned Standing Counsel appearing for the 5th respondent temple has placed before the Court, a copy of the instructions received by him in the case. A perusal of the same, would reflect that on 08.09.2025, Members of the Trust Board have already been appointed and they have also administered the oath of Office on 12.09.2025. It is further stated that renovation/reconstruction of the temple has been initiated with financial aid from CGF. Having regard to the same, this Court is of the view that the petitioners have no locus to challenge the proceedings initiated for constitution of the Trust board. In view of the foregoing, the relief sought by the petitioners for deferment of the constitution of the Trust Board till the ceremony of Maha Kumbhabhishekam is concluded, does not merit consideration.
6. The writ petition is accordingly
disposed of. There shall be no order as to costs.
