PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal petitI'On, under Sections 480 and 483 of the Bharatiya Nagarik suraksha sanhita, 2023, has been filed by the petl'tI'Oner/A3, seeking regular bal'I, in Crime No.122 of 2023 of Narsjpatnam Rural Police Station, Anakapalll' distrl'ct. 2. A case has been registered against the petitl-oner herel'n and others for the offence punishable under section 20(b)(ii)(c) p5EE
2 J} read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short lthe NDPS Act'). 3. Case of the prosecution, in brief, is that, on 04.08.2023, at about 17.00 hours, on credible information, the Sub-Inspector of police, Narsipatnam Rural Police Station, along with his Staff and mediators, while conducting vehicle checking at sadhupakaI, found Al to A4 in possession of 21 Kgs of Ganja. On seeing the police, A3 and A4 escaped from the SPOt. The police arrested Al and A2 and seized the contraband under cover of a mediators report and a case has been registered against the accused. 4. Heard.

A perusal of the material on record goes tO Show that basing on the confessional statement of co-accused, the name of the petitioner herein was shown as accused in the present crime. pursuant to the confessional statement made by the co- accused, no incrI'minating material has been Seized from the possession of the petitioner herein. The petitioner was arrested on o7.12.2024 and]`since then he is in judicial remand. Learned | Assistant The contraband allegedly seized from the possession of Al and A2 is 21 Kgs of Ganja. / 3 Prosecutor submitted that major portion of investigation I-S Jr, completed and charge sheet could not be filed for want of inventory. 6. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein/A3 on the following conditions. i) The `petitioner/A3 shall be released on bail on hI-S executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned I Additional District and sessions Judge-cum-Special Judge for trial of offences under the NDPS Act, Visakhapatnam. ii) On release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7.
