1. Challenge in this petition is to the order dated 14.01.2025, by which the petitioner has been transferred from Durg to District Balodabazar Bhatapara on the ground of administrative exigency and in her place the respondent no. 5 has been posted, on his own request.
2. Learned counsel for the petitioner would submit that the order impugned has been passed without there being any administrative exigency and only to accommodate to respondent no. 5, that too on his own request, he has been posted in place of the petitioner.
Learned counsel would also submit that the parents of the petitioner, who are octogenarian, are suffering from several ailments and nobody is there to take care of them. The order has been passed with mala fide intention and hence the same deserves to be quashed.
3. Learned counsel for the State submits that to redress the grievance of the employees who have been transferred by the State, a
3 committee has been constituted and if the petitioner will approach the committee, said committee shall consider the grievance of the petitioner in accordance with the policy of the State Government and grievance if any raised by the petitioner, the same shall be redressed within a stipulated period.
4. I have heard both the parties and perused the pleadings of the petitioner.
5. As the petitioner has raised some personal difÏculties as a ground for transfer of the present petitioner and as per the petitioner the
order impugned is also contrary to the policy of the State Government, the petitioner is directed to approach the Committee constituted by the State Government and submit a representation within a period of 10 days from the date of a receipt of a copy of this
order. If the petitioner will file any such representation before the committee, the committee is directed to consider the same and pass necessary order in accordance with the policy of the State Government by considering the grievance of the petitioner within a further period of 25 days. The interim order dated 23.01.2025 shall remain operative till then. The petitioner is at liberty to apprise the committee about the order passed by this Court.
6. With the aforesaid liberty and direction, the writ petition is disposed of. Sd/-
