ORAL ORDER:
Heard Sri M. Pawan Kumar, learned Counsel appearing on behalf of Sri C.V.R Rudra Prasad, learned Counsel for the Writ Petitioner and Sri K. Arjun Chowdary, learned Assistant Government Pleader for Registration and Stamps.
2. Sri K. Arjun Chowdary, learned Assistant Government Pleader for Registration and Stamps has drawn the attention of this Court to the Refusal
Order passed by the Sub Registrar, dated 19.11.2024 (Ex.P4). On perusal of the said Refusal Order, it transpires that the Registrar has declined to entertain the request of the Writ Petitioner because there is an Attachment
Order passed by the Civil Court in O.S.No.176 of 2024 on the file of Civil Judge (Junior Division), Kamalapuram, which is the reason why the subject property has been placed under Section 22 a(1)(b) of the Registration Act.
3. Having regard to these facts, this Court is of the opinion that the Writ Petitioner would have to approach the respective Civil Court and take necessary steps after doing sufficient due diligence in the said matter. When there is an Order of Attachment in respect of the subject property, this Court would not exercise its Writ Jurisdiction in varying with that Order without the properties in the said Suit being before this Court. In any case, it is the Civil Court alone which has to consider the issue on merit and decide whether the said Order of Attachment should be continued or be relaxed.
4. In this view of the matter, the present Writ Petition is devoid of any merit. Hence, this Writ Petition stands dismissed. No order as to costs.
5. Needless to state that liberty is always available to the Writ Petitioner to approach the appropriate forum by initiating appropriate proceedings.
6. Interlocutory Applications, if any, stand closed in terms of this order.
