CASE NO.860/2024 (BALLARI WOMEN P.S. CRIME NO.76/2024) FOR ALLEGED OFFENCES U/S 363, 366(A), 376, 114 R/W 34 OF IPC AND U/S 4, 6 OF POCSO ACT 2012 AND U/S 9 AND 10 OF PCM ACT, PENDING ON THE FILE OF ADDL.DISTRICT AND SESSIONS JUDGE CUM FAST TRACT COURT-I, BALLARI. ORAL ORDER (PER: THE HON'BLE MR. JUSTICE V.SRISHANANDA)
Heard Sri.A.Veeranna, learned counsel for the petitioner, Smt.Girija S. Hiremath, learned High Court Government Pleader and Sri.Prashant Mathpati, learned counsel for respondent No.2/de-facto complainant. 2. Petitioners are the parents of accused No.1 who have been charged with the offences under the provisions of POCSO Act as admittedly, accused No.1 has married a minor girl. 3. It is also submitted at the bar that accused No.1 has been granted bail by the learned Special Judge. - 3 -

4. Taking note of the same, present petitioners are also entitled for an order of grant of anticipatory bail by resorting to the special powers vested in this Court. 5.
Further, directing the petitioners to join the investigation would facilitate the investigation process as well as admittedly, petitioners are not available to the investigation agency from the date of registration of the case. 6. Others apprehensions expressed by the prosecution can be met with by imposing suitable and stringent conditions. 7. Accordingly, the following:
ORDER i. Bail Petition is allowed. ii. Petitioners are
directed to join the investigation by appearing before the Investigation Officer on 12.05.2025 positively at 10.00 a.m.

iii. Investigation Officer is at liberty to take the petitioners to custody and complete the custodial interrogation on the very same day before 5.00 p.m. iv. Thereafter, petitioners are directed to be enlarged on bail on executing a bond in a sum of Rs.50,000/- with one surety for the likesum to the satisfaction of the Investigation Officer. v. Petitioners shall cooperate with the investigation agency in all respects. vi. Petitioners shall mark his attendance before the Investigation Officer on every third Sunday between 10.00 a.m. to 2.00 p.m. till the final report is filed. vii. Petitioners shall not directly or indirectly tamper the prosecution witnesses in any manner.

viii. Petitioners shall attend the Court regularly. ix. Petitioners shall not leave the jurisdiction of Ballari and Kurnool Districts without prior permission.
Violation of any one of the above conditions, would entitle the prosecution to seek for cancellation of bail. Ordered accordingly.
