GP FOR REVENUE The Court made the following: 3 THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.32866 of 2025 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring respondent No.4 in attempting to dispossess me from the land in an extent of Ac.5.00 cents in Plot No.430, Sy.No.942, Madakalavari Palle, Gopavaram Mandal, Y.S.R District without adhering to due process of law as arbitrary, illegal, contrary to the provisions of the A.P.Land Encroachment Act, 1905 and also the well established legal principles apart from being violative of the fundamental and Constitutional rights guaranteed to me under Articles, 14, 19, 21 and 300-A of the Constitution of India and consequently direct the respondent No.4 not to interfere with the land in an extent of Ac.5.00 cents in Plot No.430, Sy.No.942, Madakalavari Palle, Gopavaram Mandal, Y.S.R District…” 2. Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents. 4 3. Learned Assistant Government Pleader, on instructions, has submitted that prima facie the land in Survey No.942 of Madakalavari Palli Village of Gopavaram Mandal is a Government land and in view of the fast growth of Badvel Municipality the then Mandal Revenue Officer had granted house site pattas to the house less poor families long back and at present the respondents are not interfering with the possession of the petitioner and when the respondents have found some irregularities, knowing the same, the petitioner has approached this Court with an apprehension. 4. 4. Considering the said submissions, without going into the merits of the case, the Writ Petition is disposed of directing the respondents not to dispossess or not to interfere with the possession of the petitioner in respect of the subject land without following due process of law. There shall be no order as to costs.
