Learned counsel for the petitioner submits that the petitioner was granted interim bail vide order dated 22nd April, 2024. However, the petitioner on account of communication gap did not appear before the Court on 12th November, 2024. Hence, the warrant was issued against the petitioner. The petitioner surrendered before the Court on 29th July, 2025 and moved an application for bail which was dismissed. 2 2. Learned counsel for the State has opposed the bail application on the ground that the petitioner misused the liberty granted to him. 3. The alleged recovery from the possession of the petitioner is intermediate quantity. 4. Taking into the facts and circumstances, the application for bail is allowed. 5. Petitioner shall be released on bail upon furnishing a personal bond of Rs.20,000/- with two sureties of like amount each, one of whom must be local, subject to the satisfaction of the learned Judge, Special Court (under NDPS Act), 1st Court, Jalpaiguri and also on conditions that the petitioner shall not leave the jurisdiction of New Jalpaiguri Police Station till the conclusion of the trial and the petitioner shall not threaten or intimidate or tamper with the witnesses in any manner whatsoever and the petitioner shall attend the trial regularly. 6. CRM (NDPS) 347 of 2025 is disposed of. 7. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
