Order No.02 Dated- 20.02.2025
No one turns up on behalf of either of the parties in-spite of repeated calls. Apprehending their arrest, the petitioners have moved this Court for grant of privilege of anticipatory bail in connection with B.S. City P.S. Case No.124 of 2022 corresponding to G.R. Case No. 1181 of 2022 registered under sections 323, 342, 347, 348, 364, 387, 376, 511 & 34 of the Indian Penal Code. Perusal of the record reveals that the allegation against the petitioners is that the petitioner no.1 confined the husband of the informant-victim who was working as a manager in the petrol pump owned by the father of the petitioner no.1, as the husband of the informant misappropriated several lakhs of rupees of the petrol pump and the petitioners attempted to commit rape upon the victim. Perusal of the record reveals that police after investigation of the case submitted final report against the co-accused persons of the case and did not send them up for trial but the learned Judicial Magistrate, Bokaro differing from the final report has taken cognizance. It is further averred in the anticipatory bail application
that the allegations against the petitioners are all false and are general and omnibus in nature. It is next averred in the anticipatory bail application that from the side of the petitioners, Bokaro Thermal P.S. Case No. 80 of 2022 has been instituted against the husband of the informant. Perusal of the record further reveals that the informant-victim has sworn an affidavit before the Notary Public, Bokaro dated 23.09.2024 mentioning therein that she has compromised the dispute with the petitioners outside the court and she is not desirous of prosecuting the case against the accused persons of B.S. City P.S. Case No. 124 of 2022. It is also averred in the anticipatory bail application that the petitioners are ready and willing to abide by any terms and condition as imposed by this Court. Considering the aforesaid facts of the case, I am of the opinion that it is a fit case where the abovenamed petitioners be given the privilege of anticipatory bail. Hence, in the event of their arrest or surrender within a period of six weeks from the date of this order, they shall be released on bail on depositing cash security of Rs. 10,000/- each and on furnishing bail bond of Rs.
25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Bokaro, in connection with B.S. City P.S. Case No.124 of 2022 corresponding to G.R. Case No. 1181 of 2022 with the condition that the petitioners will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish their mobile number and photocopy of the Aadhar Card with an undertaking that they will not change their mobile number during the pendency of the case and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
