Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 24/01/2025 1. By way of this petition, the petitioner has prayed for following relief:- “10.1 That this Hon'ble Court may kindly be pleased to direct the respondents to grant of 3rd time bound pay scale to the petitioner as per Government circular in his pensionery benefit with arrears, with interest, in the interest of the justice. 10.2 That, any other relief which the Hon'ble Court may deemed fit and proper also be granted to the petitioner, in the interest of justice.” 2. Learned counsel for the petitioner submits that the petitioner was appointed in the year 1980 & regularized on 1985 and he was retired from services in the year 2021. During his period of service, after completion of 10 years and 20 years, he got benefit of first and second time pay 2015 scale. The petitioner has completed 30 years of services in the year 2015 but, he was not provided benefit of third time pay scale for which he is entitled for. Learned counsel appearing for the petitioner further submits that the petition may be disposed of at this stage itself giving liberty to 3 the petitioner to make a representation before the competent authority/respondent No. 2 & 3 and in turn, respondent authority may also be directed to consider and decide the same within the stipulated period which may be fixed by this Court. 3. The above prayer made by the Counsel for the petitioner is not opposes by Counsel for the respondents. 4. In view of the above submissions made by the counsel for the petitioner, at this stage, the present writ petition stands disposed of giving liberty to the petitioner to make a representation before respondent No. 2 & 3/Competent authority raising all grounds as raised in this writ petition within three weeks from today and upon submission of such representation, respondent No. 2 & 3/ competent authority in turn are also directed to consider and decide the same in accordance with the law and relevant rules within an outer limit of '60 days' thereof. It is clarified that this Court has not expressed any opinion on the merits of the case. 5. With the aforesaid direction, the present writ petition stands disposed of. 6. CC as per rules.
