Brief facts of the case are that marriage of the parties was solemnized on 07.05.2009 at village Purgaon as per Hindu rites and customs and out of the said wedlock, two children were born. It is alleged that after the marriage, the Petitioner was subjected to torture by the family members of the Respondent/husband for various reasons. It is further alleged that the Respondent/husband was having a love affair with another lady due to which, he has ousted the Petitioner and her children from his house in the month of May, 2022. As the Petitioner was not financially well off, therefore, she has moved an application under Section 125 Cr.P.C for grant of maintenance and later on, a compromise took place between them, owing to which, she was to be paid Rs.10,000/- every month. The Respondent/husband has filed a divorce petition in order to get remarried for which, the Petitioner was issued notice to appear before the concerned Court.

Learned Counsel for the Petitioner/wife submits that the Petitioner/wife is a home maker and is having the responsibility of raising two daughters aged 14 and 9 respectively and it is very difficult for her to attend the proceedings at Family Court, Mungeli, which is 110 kms away from her place and therefore, the said case may be transferred as prayed for.

4. Having considered the submissions made, this Court deems it appropriate to transfer Civil Suit No.28-A/2025 from the Family Court, Mungeli to the Family Court, Janjgir, District Janjgir-Champa with immediate effect. Ordered accordingly. The parties are
directed to appear before the Family Court, Janjgir, District Janjgir- Champa on 28/11/2025 for further proceedings. The Family Court, Mungeli shall transfer the record to the Family Court, Janjgir, District Janjgir-Champa immediately.
5. Resultantly, the instant Transfer Petition is allowed.
6. In view of above, all the pending applications stand disposed of.
