GP FOR HOME The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 25731/2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring that the respondent No. 4 cannot interfere in any family disputes between the petitioner and the 5th respondent at her instance the 4th respondent police cannot pressurize the petitioner to marry the 5th respondent being illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India apart from being violative of Principles of Natural Justice and consequently direct the 4th respondent not to interfere with the personnel life and liberty of the petitioner and pass...…” 2. Heard Sri Venkata Durga Rao Anantha, learned counsel for the petitioner, and Sri V.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that, it is a case of interference of police in the family disputes. 4. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that basing on the complaint of Paipuru Rama Devi Devi-5th respondent, the respondent police has registered a crime against the petitioner in Crime No.Nil, for the offences punishable under Section 417, 420, 498-A IPC and Section 4 of DP Act dated 06.12.2023 on the file of Srikalathasti Rural Police Station, Tirupathi District, except the registration of the above crime, the respondent police never interfered with the personal life and liberty of the petitioner. 5. The learned counsel for the petitioner submits that the Court may pass appropriate orders. 6. Considering the submissions, the Writ Petition is disposed of. However, the police are directed not to interfere in the family disputes except under due process of law. There shall be no order as to costs.
