Mahajan, the learned counsel for the petitioners. Also heard Mr. K. Baishya, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This application under Section 482 of the BNSS, 2023 has been filed by the petitioners, namely, (1) Bikramaditya Kashyap, and (2) Ratneswar Bania, who are apprehending their arrest in connection with an FIR lodged by one Niranti Boro in the Gorchuk Police Station on 09.12.2024. 3. The learned counsel for the petitioners has submitted that the petitioners were granted interim protection by this Court by order dated order dated 07.01.2025 and in pursuant to the directions of this Court the petitioners have cooperated in the inquiry/investigation. 4. A report was called for in connection with this case as to whether any police case has been registered against the present petitioners in Gorchuk Police Station. 5. Mr. K. Baishya, the learned Additional Public Prosecutor has produced the report dated 28.03.2025, received from the Officer-in-Charge of Gorchuk Police Station, in which it has been stated that the complaint was lodged by one Niranti Boro on 09.12.2024, and inquiry is still going on in respect of this case and no police station case has yet been registered. 6. I have considered the submissions made by the learned counsel for both sides and have gone through the materials available on record including the report dated 28.03.2025 filed by the Officer-in-Charge of Gorchuk Police Page No.# 3/3 Station. 7. Since, it appears that the petitioners have cooperated with the police in this matter, hence, in the event on the basis of the inquiry, which is pending in the said police station on the complaint of Niranti Boro, a police station case registered against the present petitioners, the interim anticipatory bail granted to the present petitioners by order dated 07.01.2025, the same shall be deemed to be made absolute with conditions that they shall continue to cooperate in the investigation. 8. With above observations, this anticipatory bail application is disposed of. 9. Let the photocopy of the report dated 28.03.2025 be kept as a part of this case. JUDGE Comparing Assistant
