The Court made the following ORDER:
1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to Issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd Respondent-Tahsildar, Badvel Mandal, Kadapa District, in issuing the notice dated 01.12.2025 bearing Ref. No. A/429/2025 fixing enquiry on 06.12.2025 by granting only three days time to the Petitioner, as insufficient, illegal, arbitrary, unreasonable and violative of the principles of natural justice and the Petitioners right to a fair and meaningful opportunity of hearing, and consequently to set aside the said notice dated 01.12.2025, and pass…”
2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3. The 3rd respondent/Tahsildar, Badvel Mandal, issued the notice dated 01.12.2025 directing the petitioner to appear for an enquiry relating to his rights over the subject property, without granting sufficient time to submit his explanation. Though the notice bears the date 01.12.2025, the same was served on the petitioner only on 03.12.2025, and therefore, no adequate opportunity was afforded to submit the relevant records. Hence the writ petition. 4. Considering the same, and without appraising the merits of the case, this Court deems it appropriate to dispose of the present writ petition by directing the petitioner herein to submit a detailed explanation to the impugned notice dated 01.12.2025 within a period of three (03) weeks
from the date of receipt of a copy of this order. Upon submission of such explanation, the 3rd respondent/Tahsildar is directed to conduct an enquiry and pass appropriate orders, after affording an opportunity of hearing to the petitioner herein.
Till such time, the respondents are directed not to take any coercive steps against the petitioner herein. 5. With the above said observation, the Writ Petition is disposed of.
