GP FOR HOME The Court made the following: 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 31817/2025 ORDER This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action and inaction of the Respondent authorities in not conducting a fair and impartial investigation in Crime No. 153/2025 on the file of Yadiki Police Station, Anantapur District, despite clear and cogent evidence establishing the petitioners absence from the scene of occurrence, as arbitrary, illegal, and violative of Articles 14 and 21 of the Constitution of India and consequently direct the Respondents herein to conduct a fair and scientific investigation by verifying the petitioners official duty records, purchase bills, tower location and call data records (CDR) pertaining to his mobile number in accordance with law and pass…” 2. Heard Sri P.Madhukar Reddy, learned Counsel for the Petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the Petitioner would submit that let there be a direction to the police to conduct a fair and unbiased investigation by collecting technical evidence which is available in this matter, since, the very contention of the Petitioner is that the Petitioner is not present at the time of the alleged incident at the scene. 4 4. Learned Assistant Government Pleader would submit that the police have already collected the Call-Data and all the technical evidence available and they may finalize the investigation and file a report in a couple of weeks. 5. Considering the submissions, this Writ Petition is disposed of. However, the police are directed to look into the representation of the Petitioner and conduct the investigation in a fair way, by collecting all the technical evidence available for the relevant period and conclude the investigation and file a report according to law as expeditiously as possible. There shall be no Order as to costs.
