THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING, THIS DAY ORDER WAS MADE THEREIN AS UNDER:
ORAL ORDER (PER: THE HON'BLE MR. JUSTICE SURAJ GOVINDARAJ)
1. The petitioner is before this Court seeking for the following reliefs: i. Issue a writ in the nature of certiorari or any other appropriate writ to quash the order bearing E- 42099/RTC(D)/58TH BATCH CT (GD)/CALLUP NOTICE/TRG/2023-51338-(E) dated 26.12.2024 passed by the respondent no.3 vide ANNEXURE-A;
ii. Issue a writ in the nature of certiorari or any other appropriate writ to quash the letter bearing No.E- 37023/RTC DEOLI/58TH BATCH CT (GD)/MEDICAL CORRES/TRG/2023-50004-(E) dated 29.10.2024 passed by the 3rd respondents as per ANNEXURE-V;
iii. pass any such other order or orders as this Hon’ble court deems fit under the given circumstances of the

cases including the award of the costs of this petition in the interest of justice and equity. 2.
The petitioner is aggrieved by the report of the Medical Board and the Review Medical Board declaring the petitioner to be unfit for the post of constable in CISF. 3.
Learned counsel for the petitioner submits that though the report indicates that there is varicose veins in the posterior part of the right leg, the petitioner is a national level kabaddi player and the varicose veins have never come in the way of the petitioner in competing at national level and will not come in the way of discharge of a role as a police constable with the CISF.

The medical board certification only indicates varicose veins on the posterior side without indicating whether the same would come in the way of the petitioner discharging the role of a police constable in CISF; it was, but required for the Medical Board to also opine on the same. Not having been done, I am of the

opinion that the matter would have to be referred to the Medical Board once again to opine on the above. As such, I pass the following:
ORDER i. The writ petition is allowed. Annexures-A and B are kept under suspension. ii. Respondent No.4 shall refer the petitioner to the appropriate Medical Board, and the appropriate medical board shall examine the petitioner and opine on whether the varicose vein condition of the petitioner would come in the way of her discharging a role as a constable in the CISF. Such reference shall be made by respondent No.1 within one week from today. Report of the Medical Board shall be forwarded to respondent No.4 within one week thereafter and necessary action be taken thereafter. Sd/- (SURAJ GOVINDARAJ) JUDGE LN/ List No.: 1 Sl No.: 53
