Learned counsel for petitioner submits that respondent No.3 has passed an order of eviction against respondents No.4 and 5 vide order dated 06.10.2025 and thereafter, Tahsildar has issued eviction warrant/order on 24.10.2025 addressing to Revenue Inspector. When encroachment is not removed by respondent No.4 and 5, Tahsildar has also written letter to Outpost Incharge of Police Station Nawagarh, District Bemetara on 07.11.2025 for providing police force for maintaining law and order at the time of removing encroachment, BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN Date: 2025.12.19 10:30:36 +0530
2 however, till date the encroachment made by respondents No.4 and 5 is not removed. Petitioner thereafter, submitted representation before the Collector as also before the Sub-Divisional Officer i.e. respondents No.1 and 2 on 23.10.2025, which is also pending and no action has been taken on his representation, therefore, a direction be issued to respondents No.1 to 3 to consider and take decision on his representation.
2. Learned State counsel submits that in view of the limited prayer made by learned counsel for petitioner, he is having no objection.
3. On due consideration of the submission of learned counsel for parties and further that Tahsildar/competent authority has already issued an
order of eviction of respondent No.4 and 5, memo deputing Revenue Inspector to initiate proceedings of removing the encroachment and when encroachment is not removed, the help of police force is also sought but according to submission of learned counsel for petitioner, till date the encroachment is not removed and representation is pending consideration, I find it appropriate to dispose of this writ petition directing respondents No.1 to 3 to consider and take decision on the pending representation submitted by petitioner in accordance with law expeditiously preferably within further period of three weeks from the date of receipt of copy of this order.
4. With the aforesaid observations and directions, this petition stands
