For Petitioner(s): Mrs.P.Uma For Respondent(s): Mr.S.Balaji Government Advocate (Crl.Side) ORDER The petitioners, who apprehend arrest in the hands of the respondent police for the offence punishable under Sections147, 447, 427, 342, 294(b), 323 & 506(II) IPC, in connection with a case in Crime No.575 of 2020, seek anticipatory bail. 2. The case of the prosecution is that the petitioners along with other accused trespassed into the property of the de facto complainant on account of previous enmity, assaulted the de facto complainant besides abusing him in filthy language and hence, the petitioners have committed the aforesaid offences. https://www.mhc.tn.gov.in/judis CRL OP No. 12863 of 2025 3. The learned counsel for the petitioners would submit that the allegations are false and the petitioners were not arrested during investigation; that a civil suit filed by the petitioners is pending in O.S.No.144 of 2021 before the IV Additional District Munsif Court, Salem; that in any case, the allegations are borne out by records and that the custodial interrogation of the petitioners is not required. Stating so, he sought anticipatory bail for the petitioners. 4. The learned Government Advocate (Crl.Side) reiterated the prosecution case and submitted that the investigation has now been completed and final report has been filed in C.C.No.1158 of 2024 before the Judicial Magistrate Court No.III, Salem. 5. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) for the respondent police and perused the materials available on record. https://www.mhc.tn.gov.in/judis CRL OP No. 12863 of 2025 6. Considering the nature of allegations and since the allegations are borne out by records, and since the custodial interrogation of the petitioners is not required at this stage as the final report has been filed, this Court is inclined to grant anticipatory bail to the petitioners on certain conditions. 7. https://www.mhc.tn.gov.in/judis CRL OP No. 12863 of 2025 6. Considering the nature of allegations and since the allegations are borne out by records, and since the custodial interrogation of the petitioners is not required at this stage as the final report has been filed, this Court is inclined to grant anticipatory bail to the petitioners on certain conditions. 7.
