Learned counsel appearing for the petitioner as well as
learned counsel appearing for respondent No.4 jointly submit that the petitioner and respondent No.4 have amicably settled their dispute and have entered into a compromise and accordingly the petitioner does not want to pursue the instant petition.
2. I.A. No.1 of 2025, which is an application on behalf of the petitioner and respondent No.4 for disposal of the instant writ petition on the basis of compromise, has been filed today itself. Para 2 of the application reads as under:
“2. That during the pendency of the instant writ petition the petitioner and respondent No.04 amicably settled their dispute and have entered into compromise under the following terms and condition :- i. That the petitioner and the respondent No. 04 will be equally entitled with 50%-50% share in the total amount of compensation amount of Rs. 25,15,374/- and the also equally entitled with 50%-50% share in the interest as awarded. ii. That the petitioner and the respondent No. 04 will file a joint application before the Sub-Divisional Officer (Land Acquisition Officer) for receipt of amount as
directed in its order passed by this Hon'ble Court.
3 iii. That the above mentioned settlement is a onetime full and final settlement for the claim of compensation with respect to the compensation amount regarding land bearing Kh. No. 484/5 area 0.809 hect. situated at Vill- Chharachha, P.H. No. 04, R. N. Circle Saradi Baikunthpur, Tah. Baikunthpur, Dist- Korea (C.G.), iv. That this settlement will be binding upon the petitioner and respondent No. 04 also their legal representatives and they will no right what so ever to raise any other claim before any court or authority in light of this full and final settlement.”
3. In view of the joint submission made by learned counsel appearing for the parties and I.A. No.1 of 2025, the writ petition is disposed of. It is made clear that this Court has not made any observation into the merits of the case. Sd/-
