2. By present petition, the petitioner is seeking temporary bail for a period of six months to undergo medical treatment at KEM Hospital, Mumbai. He is suffering from ‘Diffuse (Chronic) parenchymal liver disease with spelenomegaly with significant ascitis’. He is on continuous medication.
3. The petitioner is convicted for the offence punishable under Section 302 of the Indian Penal Code, 1860. He has undergone imprisonment for about 19 years. His condition appears to be very serious. Accordingly, he wishes to have treatment at his own expenses at KEM Hospital, Mumbai, which is said to be a hospital where the disease referred to above is well treated.
4. Learned A.P.P. as such has no objection but submits that necessary treatment is available at Government Medical College, Nagpur as well at free of costs.

However, considering the ailment, which the petitioner is suffering from and his desire to have treatment at KEM Hospital, which ultimately will give him and his family members a satisfaction that a proper treatment was extended to him and also considering the period of imprisonment undergone by the petitioner, we feel it appropriate to permit the petitioner to take treatment from the hospital of his own choice.
6. Accordingly, the writ petition is allowed. Petitioner – Anil Laxman Jawade be released on temporary bail for a period of six months from today for taking treatment at KEM Hospital, Mumbai on furnishing P.R. Bond of Rs.50,000/- with one or two sureties in like amount. The petitioner shall report to KEM Hospital, Mumbai within 15 days from today. Dean, KEM Hospital, Mumbai shall make arrangement to extend necessary treatment to the petitioner and shall file report of his health condition and treatment given to him by 30.09.2025. Further orders shall be passed on 30.09.2025.
