GP FOR HOME The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 27515/2023 ORDER: The writ petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a Writ or order or direction more particularly one in the nature of Writ of MANDAMUS declaring the action of the Respondent.No.4 to No.7 in harassing, impeding and obstructing the life and liberty of the petitioners, meddling into the 'civil/family disputes', compelling to settle the property disputes, and break- open the lock of the Petitioner.No.'s house at Sy.No.443/A2, D.No.4-117, are highly illegal, arbitrary, misuse of power, without Jurisdiction and also contrary to established procedure under Civil Procedure Code (CPC) and Code of Criminal Procedure (CrPC), apart from violation of the fundamental rights enshrined under Art.19 and 21 of the Constitution of India and consequently direct the Respondent.No.4 to No.7, not to interfere with the 'civil/family disputes', and compelling the petitioners to settle the property issues and/or pass such...” 2. Heard Ms.DheeraKanishka, learned counsel for the petitioner and the learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that, it is a case of interference of police in civil disputes. 4. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions would submit that respondent No.8 made a complaint against the petitioner. Basing on the complaint, the respondent police entered into petition enquiry register vide Sl.No.125 of 2023, dated 04.09.2023 and called the petitioner to the police station for preliminary enquiry. But the petitioner did not turn up to the police station for enquiry. He further submits that the police never interfered in the civil/family disputes between the parties and never insisted the petitioner to settle the civil disputes between them. 5. Considering the submissions, the writ petition is disposed of. However, police are directed not to interfere in the civil/family disputes, except under due process of law. There shall be no order as to costs.
