Neutral Citation No. - 2025:AHC:72035 Court No. - 5 Case :- WRIT - A No. - 6019 of 2025 Petitioner :- Kamini Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Rajesh Tewari,Siddharth Pandey,Vinay Pandey Counsel for Respondent :- Arun Kumar,C.S.C.,Vijay Bahadur Maurya Hon'ble Ajay Bhanot,J. The petitioner is the step daughter of the deceased- employee. She claims that certain service benefits as well as G.P.F. of her step mother (deceased-employee) have not been paid till date. She has made a representation before the competent authority but to no avail. The only prayer made by Shri Rajesh Tewari, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Arun Kumar, learned counsel for the respondent Nos.2 and 3 submit that the matter requires determination of facts by the competent authority in light of the applicable provisions of law in the first instance. However, they fairly contend that the claim for payment of retiral dues of her deceased-step mother is liable to be decided by the competent authority in a reasonable time frame. In wake of the submissions made at the Bar and without going into the merits of the case, the respondent No.2- Nagar Ayukt, Nagar Nigam, Prayagraj is directed to
decide the representation of the petitioner regarding payment of retiral dues of her deceased-step mother, after determining the genuineness of the credentials of the petitioner and noticing all other legal heirs of the deceased-employee in accordance with law within a period of four months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally
disposed of.
