This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.749/2025 registered at Police Station – Kotwali, Korba, District Korba (C.G.) for the offences punishable under Sections GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.11.26 16:55:15 +0530 2 115(2), 296, 3(5), 309(6), 324(5), 351(3) of Bharatiya Nyaya Sanhita, 2023. 2. Case of the prosecution, in brief, is that the F.I.R. of the incident was lodged by Karandeep Singh, S/o. Jagraj Singh on 13.10.2025 at near about 06:10 Hours, the F.I.R. was lodged inter alia on the allegations that, he is the owner of Jashna Resort, Situated at Darri Road, Korba. On 12.10.2025 a cultural program of Sapna Choudhary was organized in his hotel. After completion of the said program Anil Dwivedi (applicant herein) along with Amit Navranglal, Yugal Sharma, Sujal Agrawal have abuse the brother of the complainant namely Snehdeep@Goldi and staff of the resort and assaulted them and has snatched/looted the Laptop, DVR Set and Rs. 10,000/- from reception counter. On the basis of the said allegation the F.I.R. has been registered. 3. Learned counsel for the applicant submitted that three co- accused persons have already been enlarged on anticipatory bail by this Court namely Yugal Sharma and Sujal Agrawal in MCRCA No.1719/2025 on 10/11/2025 and Anil Dwivedi in MCRCA No.1699/2025 on 6/11/2025. He further states that so far as the criminal antecedents of the applicant is concerned which are 8 in number, out of which, in 7 cases he has been acquitted and one case is pending. Therefore, he submits that the present applicant is entitled to be released on anticipatory bail on the ground of parity. 3 4. On the other hand, learned State counsel as also learned counsel for the objector oppose the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, considering the fact that three co- accused persons have already been enlarged on anticipatory bail by this Court namely Yugal Sharma and Sujal Agrawal in MCRCA No.1719/2025 on 10/11/2025 and Anil Dwivedi in MCRCA No.1699/2025 on 6/11/2025, therefore, I am inclined to grant anticipatory bail to the present applicant on the ground of parity. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Amit Navrang Lal, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on 4 each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
