Mr. Harshpal Shekhon, learned counsel for the applicant. 2. Mr. Deepak Bisht, learned Deputy Advocate General, assisted by Mr. Devendra Singh, A.G.A. for the State. 3. Applicant- Ajay, who is in judicial custody in connection with Case Crime/FIR No. 165 of 2022, under Sections 363, 376, 302, 201 and 120-B IPC and Section 5/6 Protection of Children from Sexual Offences Act, 2012 registered at Police Station Kiccha, District Udham Singh Nagar, has sought his release on bail. 4. Heard learned counsel for the parties and perused the material available on record. 5. Learned counsel for the applicant submits that there is no chance of tempering the witnesses; except the confessional statement of the applicant and the statement of last seen witness, there is no other credible evidence against the applicant; the applicant has no previous criminal history; there is no independent witnesses of the evidence and only on the basis of extra judicial confession, the applicant has been implicated in this case. 6. Per Contra, learned Deputy Advocate General submits that age of the victim is only 3 ½ years. 7. Considering the nature and heinousness of the crime this Court is of the view that the applicant does not entitled to be released on bail.
