This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.47/2025 registered at Police Station – Bagicha, District-Jashpur (C.G.) for the offences punishable under Sections 74, 75(2), 331(5) of BNS, 2023. Prosecution story as stated in bail rejection order based on case diary is that, the applicant entered under drunken condition, in the victim's house when she was alone at around 1:00 AM night of 23-02-2025, and under intoxicated state of mind applicant forcefully caught victim's hand, kissed lips and grabbed breast, and when she told to narrate these incidents with her husband, the applicant ran away. Victim narrated the incident with her husband and gave written report on the basis of which crime no 47/2025 registered by Bagicha police against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. He would submit that just to evade from burden of payable amount, victim and her husband lodged false and fabricated case against the applicant, investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail and submits that statement recorded under Section 161 of the Cr.P.C, in which prosecutrix has made allegation against the present applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, gravity of offence, also looking to the statement recorded under Section 3 161 of the Cr.P.C. of the prosecutrix, as such, I am not inclined to grant anticipatory bail to the applicants. 7. Accordingly, the anticipatory bail application of the applicant– Ravishankar Gupta filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.47/2025, registered at Police Station–Bagicha District – Jashpur (C.G.) for the alleged commission of offence punishable under Sections 74, 75(2), 331(5) of BNS, is rejected.
