MEHTA Date : 03/10/2025 ORAL ORDER By way of this petition under Article 226 of the Constitution of India, the petitioner has approached this Court for seeking appropriate writ, order or direction upon the respondent to provide electricity connection to the petitioner. Heard Mr.Rathin P. Raval learned advocate for the petitioner and Mr.Mitesh Rangras learned advocate for the respondent. Mr.Mitesh Rangras learned advocate for the respondent – PGVCL, under the instructions, states that the respondent – PGVCL has no objection to provide the electricity connection to the petitioner; however, it is requested to this Court to clarify that the theft case registered against one Jaydeepbhai Dilipbhai Somaiya, a contractor of the petitioner at the relevant point of time may not be prejudiced by giving consent C/SCA/10851/2025 ORDER DATED: 03/10/2025 of providing electricity connection to the petitioner. In view of the above, the respondent – PGVCL shall provide the electricity connection to the petitioner within a period of 15 days from today, after completing all the necessary formalities. Needless to clarify that by extending consent would not come in the way of respondent – PGVCL to pursue the remedy availed in connection with the theft case registered against the contractor of the petitioner.
