K V RAGHU VEER The Court made the following ORDER: The above contempt case is filed complaining violation of the order dated 03.09.2013 in W.P.No.24988 of 2013. 2. The W.P.No.24988 of 2013 is filed by the petitioner- Educational Institutions, challenging the Memo No.12080/COSE/A2/2004-4, dated 20.10.2004 issued by the State Government. The W.P.No.24988 of 2013 was allowed, directing the respondents to accord permission to the institutions to fill up vacant grant-in-aid posts per the Rules. 3. Petitioner No.23 filed the above contempt case complaining violation of the order dated 03.09.2013. 2 4. Sri K.Raghuveer, learned counsel for the respondents, submitted the instructions of the District Educational Officer, Prakasam District, Ongole wherein it was mentioned that the total strength of the children in the school is 63 and the total sanctioned strength of teachers is 10. Out of 10, four (4) secondary grade teachers have been working (aided). Six (6) posts are vacant as per the teacher-pupil ratio as per Rule 10(12) of G.O.Ms.No.1, Education (PS2) Department, dated 01.01.1994, there is no need to fill up vacant aided posts. 5. Given the instructions, considering the strength of the children, this Court does not find any violation of the order dated 03.09.2013 in W.P.No.24988 of 2013. 6. Accordingly, the contempt case is closed. No order as to costs.
