The petitioner is before this Court seeking for the following reliefs: a. Issue writ of Mandamus directing the respondent no. 1 to consider the - 3 - HC-KAR NC: 2025:KHC-D:11657 WP No. 104634 of 2025 representation made by the petitioner vide Annexure-A dated. 21-04-2025. b. Issue writ of Mandamus directing the respondent no. 2 to consider the representation made by the petitioner vide Annexure-B dated. 21-04-2025. c. Issue writ of Mandamus directing the CENTRAL BUREAU OF INVESTIGATION (CBI) to conduct the enquiry about crores of rupees corruption in the Board by the R1 and R2. 2. Learned counsel for the petitioner has filed a memo giving up the relief at Para No.(c) above. 3. In that view of the matter, the relief at Para No.(c) is deleted. 4. Learned counsel for the petitioner to carry out necessary endorsement in the petition forthwith. 5. The grievance of the petitioner is that the petitioner has not been provided the benefit despite the petitioner having made payment under the Ayushman Scheme and certain other schemes by the respondents collecting necessary cess under the - 4 - HC-KAR NC: 2025:KHC-D:11657 WP No. 104634 of 2025 Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996. 6. The petitioner having a vested right in respect of his claim, any claim made by the petitioner would have to be considered by the respondents in accordance with law in terms of the above Act and any scheme applicable thereto, and pass necessary orders on any representation and or claim submitted by the petitioner. 7. The same not having not been done, I pass the following: ORDER i. Writ petition is allowed. ii. A mandamus is issued directing respondent No.2 to consider the representation of the petitioner at Annexures - A and B and pass necessary orders in accordance with law within 4 weeks from the - 5 - HC-KAR NC: 2025:KHC-D:11657 WP No. 104634 of 2025 date of receipt of a copy of this order, if not already considered.
