This Writ Petition is filed under Article 226 of the Constitution of India by the Petitioners for the following relief: …” to issue an order, direction or a proceeding or a writ one in the nature of mandamus declaring the action of the Respondent no.3/Sub collector/RDO Palamaner in not disposing off the stay application/IA filed by the writ petitioner in the Appeal file by the writ petitioner vide ROR Appeal No.Roc.C 2041 dt. 1-9-2025 as illegal arbitrary and in violation of the provisions of the AP Pattadar Pass Book Act 1971, the constitution of India, and consequently direct the Respondent no.3/Sub Collector/RDO Palamaner Chittoor district to dispose off the the stay application/IA filed by the writ petitioner in the Appeal file by the writ petitioner vide ROR Appeal No.Roc.C 2041 dt. 1-9-2025 and pass…”
2. Heard the learned counsel for the petitioner and the learned Government pleader for the respondents. 3. The present Writ Petition is filed aggrieved by the inaction of Respondent No.3/Sub-Collector-cum-Revenue Divisional Officer, Palamaner, in not disposing of the stay application/interlocutory application filed by the petitioner in ROR Appeal No. Roc.C 2041 dated
01.09.2025. The petitioner contends that such inaction is illegal, arbitrary

and violative of the provisions of the A.P. Pattadar Pass Book Act, 1971, as well as the principles of natural justice. 4.
The learned counsel for the petitioner has submitted that the land admeasuring Ac.0.28 cents out of a total extent of Ac.5.32 cents situated in Raganipalle Village, Punganur, originally belonged to late Sri Reddipalle Sarvottham Rao, whose family acquired the same under a Zamindari Inam granted during the period 1956–1960. The property was subsequently mortgaged under Document No.479/1965 and Document No.593/1967. Upon the demise of the petitioner’s father in the year 2008, the petitioner applied for mutation, and the Mandal Revenue Officer, Punganur, issued the Pattadar Passbook and Title Deed in the year 2015 after conducting due enquiry as mandated under law. It is further submitted that the unofficial respondent/Respondent No.5, in collusion with certain revenue officials, managed to obtain an 1-B Adangal in his favour with respect to the subject land without issuing any statutory notice to the petitioner and has been interfering with the petitioner’s peaceful possession. The petitioner thereafter instituted O.S.No.253 of 2025 seeking injunction and secured an interim order in I.A.No.355 of 2025 on
28.10.2025. However, the said interim order was vacated on the basis of an 1-B Adangal alleged to have been fraudulently procured by Respondent No.5. He further submits that the petitioner preferred an

appeal before the Revenue Divisional Officer on 01.09.2025. However, during the pendency of the said appeal, the revenue records were manipulated by merging Sy.No.268/3 and Sy.No.268/3D2 under a single Khata No.1273. It is also contended that mutations are being effected behind the petitioner’s back without issuance of notice as required under Section 5 of the A.P. Rights in Land and Pattadar Pass Book Act, 1971. The record further discloses that multiple khatas have been created in respect of the very same survey number, in addition to a merger 1-B Adangal allegedly fabricated by Respondent No.5, thereby causing serious prejudice to the rights and interests of the petitioner. Hence, the present Writ Petition. 5.
Considering the submissions made by the learned counsel on either side and upon perusal of the material available on record, as well as the orders passed by the court below, this Court is of the considered view that, the Writ Petition can be disposed of, directing the 3rd respondent/Sub-Collector-cum-Revenue Divisional Officer to consider/dispose of the interlocutory application filed by the petitioner along with the ROR Appeal No. Roc.C 2041 dated 01.09.2025, and to pass appropriate and reasoned orders strictly in accordance with law, after issuing notice to all the concerned parties and affording them an adequate opportunity of hearing. completed within a period of one (01) month from the date of receipt of a copy of this order. 6. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
