JUSTICE S G PANDIT) Heard Ms. Gayatri S.R., learned counsel appearing for the complainant, and Sri. Sharad V.Magadum, learned Additional Government Advocate appearing for the respondents/accused. 2. This contempt petition is filed under Sections 11 and 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India complaining disobedience of the order dated 08.08.2024 passed in Writ Petition No.104676/2024 wherein this Court passed the following order: “5. A Mandamus is ordered. The Assistant Director of Land Records – the third respondent is directed to consider the representation dated: 27.07.2023 submitted by the petitioner for issue of survey sketch vide Annexure-Q in accordance with the law within three months from the date of receipt of the certified copy of this order. Once a sketch is issued, the Sub-Registrar, Ballari – the fourth respondent may take necessary step for the registration of petitioner’s property in accordance with the law. 6. Resultantly, the Writ Petition is disposed of.” 3. Learned Additional Government Advocate files affidavits, dated 15.11.2025, of one Sri. K.Bellarappa, Assistant Director of Land Records, Bellary District, as well as one Sri. Devappa, Sub-Registrar, Ballari District, whereunder they - 4 - HC-KAR NC: 2025:KHC-D:15829-DB CCC No. 100212 of 2025 have stated that 11E sketch has been issued in respect of 2 acres of land in question and they have stated that the sale deed in respect of the land in question would be registered within a week, in accordance with law on an application being filed by the petitioner and on payment of necessary stamp duty. The affidavits are taken on record. 4. Learned counsel for the complainant would submit that, by recording affidavit and statement of accused Nos.1 and 2, the contempt petition may be closed with liberty to revive the petition, if the documents with regard to the property in question are not registered. In view of the undertaking given by accused Nos.1 and 2 by way of affidavits dated 15.11.2025, we drop further contempt proceedings with liberty to the complainant to revive the contempt petition if necessary.
