Neutral Citation No. - 2025:AHC:112465-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 1037 of 2025 Petitioner :- Pradyumn Singh Respondent :- State of U.P. and 4 others Counsel for Petitioner :- Shambhu Nath, Rakesh Tripathi Counsel for Respondent :- S.C. Seema Agarwal Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J. 1. This petition has been filed by the petitioner purportedly in public interest seeking a direction to the respondent nos. 2 and 3 to stop illegal mining from Araji No. 410, situated at Mauja Saridangari Khurd, Dehat Amanat, Tehsil Sadar, District Varanasi. 2. Allegations have been made that respondent no. 5 is indulging in illegal mining and instead of taking action against him, an FIR has been lodged against unknown persons and, therefore, the respondents be directed to take action against respondent no. 5. 3. Instructions have been produced inter alia indicating that inspection was carried out at Araji No. 410 wherein it was found that more than 1824 cubic meters of mining has been undertaken and as one Angad, Suddhi and Ramji were granted temporary permit to the extent of 100 cubic meters and despite notice, they did not respond to the notice, a complaint against them has been filed with the C.J.M., Varanasi in this regard. Further indication has been made that presently no mining activity is being undertaken at the said Araji No. 410. 4. In view of the indications made in the instructions, which are taken on record, wherein the respondents have already taken action in terms of the material available and the petitioner has failed to point out any basis for alleged illegal mining by respondent no. 5, we do not find any reason to continue with the present PIL and the same, consequently, stands disposed of. It is expected of the Department to pursue the complaint made before the C.J.M., Varanasi in right earnest.
