The present anticipatory bail application under sections 482 and 484 of Bharatiya Nagrik Suraksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for the offences registered under sections 467, 468, 420 & 120(B) of the Indian Penal Code, pending in the Court of learned Judicial Magistrate, 1st Class at Jamshedpur, in connection with Azadnagar PS Case No.117 of 2018, corresponding to GR No. 36/2019(s).
3. The learned APP opposes the prayer for anticipatory bail.
4. The allegation against the petitioner is that on the basis of the false bailers the bail-bond of the accused, namely, Md. Siraj was accepted and he was released. Thereafter he fled. After much effort he could be apprehended and brought before the Court in the Criminal Appeal which was pending. The matter was taken seriously by the Court, thus, an FIR was lodged alleging involvement of each of the accused persons.
5. From the FIR, I find that this petitioner was a conducting lawyer representing the accused before the trial court. There is no allegation in the FIR that this lawyer had got any hand in obtaining the bailors or identifying them. At best it can be said that he identified the mother of the accused who had brought the bailors. It is not disputed that mother of the accused is not an imposter rather she is the real person.
6. Considering the aforesaid facts, I am inclined to release the petitioner on anticipatory bail. Accordingly, the petitioner, above named,

is directed to surrender before the court below within four weeks from today and in the event of his surrender/arrest, the learned court below is
directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class at Jamshedpur, in connection with Azadnagar PS Case No.117 of 2018, corresponding to GR No. 36/2019(s)., subject to the condition that one of the bailers should be close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/ her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the learned trial court indicating his /her share in the property.
