particularly in the nature of Writ of Mandamus declaring the action of the Respondents in particular 3rd Respondent in not considering the appeal filed by the Petitioner on 12-9-2025 under the Andhra Pradesh Rights in Land and Pattadar Pass Books Act for cancellation of illegation mutations with regard to the land in Sy.No.216/5A to an extent of Ac.0.45 Cts and in Sy.No.216/5B to an extent of Ac.0.22 Cts in Bokksampalem Revenue Village, Sri Kalahasti Mandal, Tirupati District, as arbitrary, illegal, in violation of the Provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act and the Rules made there under and in Violation of Article 14, and 300A of the Constitution of India and consequently direct the Respondents in particular, Respondent No.3 to consider and dispose of the appeal filed by the Petitioner on 12-09-2025 with regard to the land in Sy.No.216/5A to an extent of Ac.0.45 Cts and in Sy.No.216/5B to an extent of Ac.0.22 Cts in Bokksampalem Revenue Village, Sri Kalahasti Mandal, Tirupati District in accordance with law and to pass Counsel for the Petitioner:

The Court made the following ORDER:
This writ petition is filed seeking the following relief:
“…to issue an appropriate Writ, Order or Direction more particularly in the nature of Writ of Mandamus declaring the action of the Respondents in particular 3rd Respondent in not considering the appeal filed by the Petitioner on 12-9-2025 under the Andhra Pradesh Rights in Land and Pattadar Pass Books Act for cancellation of illegal mutations with regard to the land in Sy.No.216/5A to an extent of Ac.0.45 Cts and in Sy.No.216/5B to an extent of Ac.0.22 Cts in Bokkasampalem Revenue Village, Sri Kalahasti Mandal, Tirupati District, as arbitrary, illegal, in violation of the Provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act and the Rules made there under and in Violation of Article 14, and 300A of the Constitution of India and consequently direct the Respondents in particular, Respondent No.3 to consider and dispose of the appeal filed by the Petitioner on 12-09-2025 with regard to the land in Sy.No.216/5A to an extent of Ac.0.45 Cts and in Sy.No.216/5B to an extent of Ac.0.22 Cts in Bokkasampalem Revenue Village, Sri Kalahasti Mandal, Tirupati District …”
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader appearing for respondents. 3. Learned counsel for petitioner submits that the petitioner has filed an appeal before the Revenue Divisional Officer on 12.09.2025. Though, lapse of three months, the 3rd respondent has not considered and not taken up the statutory appeal. Hence, the writ petition. 4. Learned Assistant Government Pleader has submitted that the authorities would consider and dispose of the appeal by following the procedure within a reasonable period. 4 DR,J W.P.No.35637 of 2025
5. Considering the submissions and on perusal of the documents, this Court is not inclined to go into the merits of the case. Hence, notice to 5th respondent is dispensed with and the writ petition is disposed of directing the 3rd respondent to consider the appeal filed by the petitioner after following the procedure, more specifically, by issuing notice to all concerned and pass appropriate orders on merits based on the records within a period of four months from the date of receipt of a copy of this order. 6. Accordingly, the writ petition is disposed of. No costs.
