Hon'ble Shri Justice Arvind Kumar Verma, Order on Board 03.12.2025 1) By way of instant Petition 昀椀led under Section 528 of Bhartiya Nagarik Suraksha Sanhita, the Petitioner is seeking a direction to JMFC, Raipur to conclude/decide the application under Section 156(3) of Cr.P.C., which is pending in as unregistered case allotted 昀椀ling no. 20174/2024. 2) Learned counsel for the petitioner submits that FIR has been registered against the private respondents on dated 27.06.2024 under section 420, 467, 468, 471, 120-B, 34 crime no. 170/2024 by the Police Station Mujgahan for using forged signature and opening Bank Account being aggrieved by the In-action of respondent
2 authorities i.e. respondent no.3 where the petitioner 昀椀led on application under section 156(3) of Cr.P.C. for monitoring of the investigation and direction in the light of Supreme Court Judgment's 2016 ruling in the case of Sudhir Bhaskar Rao Tambe Vs. Hemant Yashwant Dhange, (2016)6, SCC 277, wherein it was explicitly observed that a person aggrieved with the way investigation being done in a matter, can move on application before the magistrate under section 156(3) Cr.P.C. as the magistrate is empowered to even monitor an investigation under the said provision. 3) The application under section 156(3) of Cr.P.C is pending before the Judicial Magistrate First Class Raipur C.G. but till date the application is not concluded, neither any direction is being given to the respondent i.e. respondent no.3 to 昀椀le the charge sheet whereas the FIR is been 昀椀led on dated 27.06.2024 and charge sheet has not being 昀椀led till the date of 昀椀lling of this petition.
The FIR has been registered by the order of the Judicial Magistrate First Class which can be pursued from the FIR mentioned above. 4) To the limited prayer that the petitioner has made, is not opposed by the learned State Counsel. 5) Considering the submission made by the learned counsel for petitioner, this Court is directed the concerned Judicial Magistrate First Class Raipur Chhattisgarh to conclude/decide the application under Section 156(3) of Cr.P.C. which is pending in unregistered case allotted 昀椀ling No. 20174/2024 as expeditiously as possible, if there is no legal impediment. 6) Accordingly, the petition is disposed of.
