By way of the present writ petition, the petitioner has sought issuance of an appropriate writ in the nature of Mandamus directing respondent Nos. 2 and 6 to decide the representation dated 19.02.2025 (Annexure P-4). A further prayer has been made to set aside the candidature of respondent No.5-Kuldeep Singh (who has been elected as a Councillor from Ward No.11, Municipal Council, Pataudi Jatauli Mandi, Gurugram), in view of Section 13C of the Haryana Municipal Act, 1973 read with Sections 17, 18 and 125 of the Representation of People Act, 1951.

At the outset, learned counsel for the petitioner submits that for redressal of his grievance, the petitioner shall approach the competent authority by filing an appropriate representation/application.

Served with the advance copy of the petition, Mr. Ankur Mittal, Additional A.G., Haryana, appears on behalf of the respondents and submits that if, any such representation is filed by the petitioner, the same shall be considered and decided by the competent authority, in accordance with law.

Without commenting on merits of the case, the present petition is disposed of by giving liberty to the petitioner to file an appropriate representation before the competent authority-respondent No.6 (Returning Officer, Municipal Council Pataudi-Jatauli Mandi, Gurugram). In case, any such representation is filed, the respondent No.6 shall look into the same and pass an appropriate reasoned order thereon, in accordance with law, preferably within a period of eight weeks from the date of filing/receipt of such representation.

disposed of.
