This writ petition was filed questioning the action of the respondent authorities in taking steps to dispossess the petitioner from her land in Sy.No.53-3 in an extent of Ac.0.50 Cents situated at water streaming area of Lingalapadu Village and Nandigama Mandalam, Krishna District and in view of providing house sites under the Navaratnalu Programme and consequently declare that the revenue authorities cannot grant house site pattas in the Gramakantam lands. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 4th respondent submits that the subject land in an extent of Ac.0.64 cents in R.S.No.53-3 situated in Lingalapadu Village of Nandigama Mandal is classified as “Vagu Poramboke” and it is already included in the prohibitory lands list of Lingalapadu Village of Nandigama Mandal under Section 22-A of the Registration Act. Out of which, Ac.0.50 cents is under the possession and enjoyment of the petitioner. There is an interim order passed by this Court dated 11.08.2020. 4. In view of the above said facts and circumstances, the respondent Nos.2 to 5 are directed to deal with the subject land in an extent of Ac.0.50 cents in Sy.No.53-3 of Lingalapadu Village and Nandigama Mandalam, 4 HBKM,J W.P.No.13758 of 2020 Krishna District, strictly in accordance with law, if so warranted for any public purpose and if the petitioner is otherwise found to be in possession of the same, she shall be dealt with strictly in accordance with law, by hearing all the parties concerned, including the petitioner, giving due opportunity, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits. Any encroachment made on the subject land, shall be removed, strictly in accordance with law, by following the due procedure and the subject land shall be protected. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
