ORDER: This criminal petition has been filed, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita accused No. 3 on bail in Sitharama Raju District, 20 (b) (ii) (B) and 25 read with Section 8 Psychotropic Substances Act, 1985
2023. seeking to enlarge the petitioner- crime No. 12 of 2025 of Sileru Police Station, Alluri registered for the offences punishable under Sections (c) of the Narcotic Drugs and on the allegation of the petitioner- accused No. 3 had indulged in dealing with 5 K.Gs.of Ganja. 2. Heard learned counsel for the petitioner-accused No. 3 and learned Assistant Public Prosecutor appearing for the respondent-State. 3. The allegation against the petitioner-accused No. 3 is that he had indulged in dealing with 5 K.Gs. of Ganja. It is not a commercial quantity. The offence was taken place on 14-07-2025. The role of the petitioner No. 3 has come into light based The petitioner was arrested -accused on the confession of accused Nos. 1 and 2. on 01-09-2025. He has been in judicial custody IS permanent resident of RSC 9 Village. Odisha State. He has got fixed for the past 44 days. The petitioner i Doraguda, Chitrakonda, Malkangiri District, abode. There are the petitioner. So far, eight witnesses witnesses. Hence, chances of the petitioner tampering the evidence no similar criminal adverse antecedents reported against are examined. They are all official threatening the witnesses or hampering the investigation may not arise. or
3 Considering the facts and circumstances of the case and the nature and
4. gravity of allegations levelled against the petitioner, this Court is inclined to enlarge him on bail with the following stringent conditions: The petitioner-accused No. 3 shall be enlarged on bail subject to his executing a bond for a sum of Rs. 10,000/- (Rupees ten thousand only) with two sureties for the like sum each to the (i) satisfaction of learned Judicial Magistrate of I Class, Chintapalli; The petitioner-accused No. 3 shall appear before the Station (ii) House Officer concerned on every Saturday in between 10:00 am and 05:00 pm till filing of charge sheet; The petitioner-accused No. 3 shall make himself available (iii) for investigation as and when required; The petitioner-accused No. 3 shall not cause any threat (iv) inducement or promise to the prosecution witnesses; The petitioner-accused No. 3 shall surrender his passport, if any, to the investigating officer.
If he claims that he does not have passport, he shall submit affidavit to that effect to (V) the Investigating Officer; and The petitioner-accused No. 3 shall not leave the State of (Vi) Andhra Pradesh limits without the express permission from the Station House Officer concerned. 4 The criminal petition is accordingly allowed.
