This Criminal Revision Case has been filed by the petitioner/Accused No.1 under Sections 397 and 401 of the Code of Criminal Procedure, 1973 (for short, ‘the Cr.P.C.’) against the order dated 15.06.2018 passed in Crl.M.P.No.2704 of 2017 in C.C.No.103 of 2016 on the file of learned Chief Metropolitan Magistrate, Visakhapatnam (for short, ‘the trial Court’). 2. Heard and perused the record. 3. As seen from the record, the Crl.M.P.No.2704 of 2017 in C.C.No.103 of 2016 has been filed by the petitioner/Accused No.1 herein under Section 251 of Cr.P.C to discharge him after conducting enquiry. By impugned order dated 15.06.2018, the trial Court dismissed the petition. Against the said order, the petitioner herein preferred the revision. 4. Learned counsel for the petitioner submits that the main C.C.No.103 of 2016 was disposed on 12.12.2019. In support of this, a copy from the e-Courts website has been filed, which reflects that the said C.C.No.103 of 2016 was disposed on 12.12.2019 and convicted the accused. 5. Recording the said submission of learned counsel for the petitioner and in view of the disposal of the C.C.No.103 of 2016 on 12.12.2019, this Court finds the cause does not survive for adjudication and the matter would become infructuous. 6. Accordingly, the Criminal Revision Case is dismissed as infructuous.
