PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 917 of 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/Accused No.4, seeking regular bail, in Crime No. 29 of 2023 of Annavaram Police Station, Alluri Sitha Ramaraju District, registered for the offence punishable under Sections 20(b)(ii)(C), 25 r/w 8(c) NDPS Act. 2. Case of the prosecution, in brief, is that, on 26.09.2023, between 02.30 hours to 05.30 hours, the Sub-Inspector of Police, Annavaram Police Station, along with his staff and mediators, while conducting vehicle checking near Nimmapadu road turning point of Chinthapalli Mandal, found the accused in possession and illegal transportation of 1,401.600 kgs of Ganja in Bolero pickup van bearing registration No. AP 05 TC 6883 and a motorcycle. On seeing the police party, two persons travelling on the motor cycle escaped from the spot. The contraband along with vehicles and other material was seized under cover of mediators report and a case has been registered against the accused. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/State. Perused the material on record. 4. Learned counsel for the petitioner would submit that nothing was seized from the possession of the petitioner. The petitioner has been in 3 judicial custody since 18.11.2024. The crime is of the year 2023. The petitioner is ready to furnish the sureties to the satisfaction of the Court. Learned Counsel finally prays to allow the petition. 5. Learned Assistant Public Prosecutor would submit that the petitioner is involved in six (6) more cases. The contraband seized in the present case is 1,401.600 kgs of Ganja which is a huge commercial quantity. The statement of the other accused shows that he has purchased it from the petitioner. Investigation is not completed and finally prays for dismissal of the petition. 6. Learned Counsel for the petitioner in reply would submit that five (5) cases alleged against the petitioner were ended in acquittal and only one case is pending against him. 7. Considering the submissions made and on perusal of the material on record, the earlier application in Crl.P.No. 9576 of 2024 was dismissed by the Coordinate Bench of this Court on 28.01.2025 on the premise that it is a huge quantity of Ganja and the petitioner is involved in six (6) more cases. Admittedly the statutory period is also not over in this case. Under these circumstances, this Court is not inclined to release the petitioner on regular bail. 8.
