GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 6413 of 2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue a writ or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the official respondents Nos. 1 to 6 more particularly Respondent No.5 and 6 on the complaint of the petitioner dated 04-03-2024 to provide the protection to the petitioner by Registering the case against the unofficial Respondents No.7 and 8 and their followers as arbitrary, illegal, ultra-virus, against to the principles of natural justice apart from being violation of articles 14, 21 and 300 A of the Constitution of India, and consequently direct the official Respondents i.e. R-1 to R-6 to provide the protection to the petitioner and his family members by Register the case as per the complaint dated 04.03.2024 against the unofficial Respondents No.7 and 8 and their followers since the petitioner and his family members are having life threat with the unofficial Respondents No.7 and 8 and their followers by taking action on the petitioner's complaint dated 04.03.2024 in the interest of justice …” 2. None represented for the petitioner. 3. Sri V.Farook, learned Assistant Government Pleader for Home, on instructions, would submit that both the petitioner and the unofficial respondents gave complaints and the police have conducted preliminary enquiry and found that the subject matter is purely civil in nature. Therefore, the respondent-police are not interfering in the civil disputes between the petitioner and the unofficial respondents. 4 4. Recording the same, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties, except under due process of law. There shall be no order as to costs.
