Heard the parties.
The petitioners have been made accused in connection with Chandwa P.S. Case No. 113 of 2022, S.T. Case No.54 of 2023, for the offences under Sections 395, 397, 307, 353 & 412 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Additional Sessions Judge-II, Latehar.
On 06.10.2022 at 08:00 p.m, the informant was waylaid by dacoits at a place near Katpulia at NH-39. Dacoits looted cash and other valuables from the informant.
It appears that co-accused was apprehended at the spot. It also appears that one of the dacoits was apprehended at the spot and on his confession, the name of the petitioners has transpired.
It was submitted that petitioners have not been put on T.I. Parade. It was further submitted that nothing incriminating has been recovered from the possession of the petitioners. It was also submitted that petitioners are in custody since 24.11.2022. It was finally submitted that similarly situated co-accused Sanjay Guriya has been granted bail by this Court in B.A. No.162/2025.
In view of the aforesaid fact, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Latehar, in connection with Chandwa P.S. Case No. 113 of 2022, S.T. Case No.54 of 2023.
