Heard Mr. P. Sen Chowdhury, learned counsel along with Mr. P. S. Sarkar, learned counsel appearing for the applicants. Also heard Mr. Raju Datta, learned P.P. appearing for the respondent-State. This is an application filed under section 482 of the BNSS, 2023 for granting anticipatory bail to the applicants in connection with A.D. Nagar P.S. case No. 5 of 2025, registered under Sections 126(2)/117(2)/109/304/351(2)(3)/3(5) of the BNS, 2023. The brief fact of the prosecution story is that, one Sri Sanjit Das of Camper Bazar lodged a written complaint with the Officer-in-Charge of A.D. Nagar police station alleging inter alia that on 05.02.2025 the applicants herein with intention to kill him caused him grievous bleeding injuries. He was unconscious with bleeding injuries and nearby people took
him to IGM Hospital and the doctors finding him in critical condition referred him to GBP Hospital. Mr. Sen Chowhdury, learned counsel appearing for the applicants, has submitted that the applicants are seriously apprehending their arrest since their names have been specifically booked in the FIR. It is further submitted that the applicants have been falsely implicated with the instant case and they are in no way involved in the alleged incident. Mr. Datta, learned P.P. has produced the case diary and raised objection in granting the anticipatory bail to the applicants. Learned P.P. has also produced the injury report. I have perused the injury report as well as the case diary. From the injury report, it is found that the injury is minor and simple in nature.
Considering the nature of injury and overall materials surfaced in the case diary, I am inclined to enlarge the applicants to go on anticipatory bail. Accordingly, it is ordered that, in the event of arrest, the applicants, namely, Sri Birendra Das, Sri Sukanta Das, Sri Fulendra Das and Sri Ankur Das may be released on bail on executing a bond of Rs. 25,000/- (Rupees twenty five thousand) each with one surety each of the like amount to the satisfaction of the arresting authority on condition that the applicants shall appear before the Investigating Officer once in a fortnight and shall co-operate with the process of investigation as and when called for. With the aforesaid observations and directions, the instant application stands allowed and thus disposed of. JUDGE
