THE HON’BLE SRI JUSTICE HARINATH.N WRIT PETITION No.28380 OF 2025 & WRIT PETITION No.28404 OF 2025 ORDER
1. These writ petitions are filed being aggrieved by the action on the part of the 2nd respondent in allotting the shops which were constructed by the petitioners under the goodwill auction conducted by the 2nd respondent. 2. The learned counsel for the petitioners submits that the petitioners were successful bidders and had constructed shops with their own funds after having been assured of allotting the shops for lease for a period of 25 years by the Council resolutions dated 30.04.2022 and vide proceedings dated 05.07.2022, the petitioners were allotted shops under the auction. In pursuance of the said bidding process, the petitioners have completed the construction and requested the 2nd respondent to allot the shops which were constructed by the petitioners. In this regard, the petitioners also submitted representations dated 08.10.2025 seeking allotment of the shops. 3. The learned standing counsel for the 2nd respondent, on written instructions, submits that the goodwill auction has violated several mandatory safeguards laid down under G.O.Ms. No.21 (MA & UD)

(J2) Dept, dt.18.02.2013. It is further submitted that the officials and the Councillor are responsible for having conducted the auction in violation of the Municipalities Act. It is also submitted that some rooms were constructed on the drainage channel obstructing the public drainage. 4.
On the contrary, the learned counsel for the petitioners submits that the public auction was in pursuance of the public notice dated 02.08.2023 which was published in the newspapers and the petitioners have completed construction on the land identified and shown by the 2nd respondent. 5. Considering the submissions of the learned counsel for the petitioners and the learned standing counsel for the 2nd respondent, there shall be a direction to the 2nd respondent to consider the allotment of the shops to the petitioners in pursuance of their representations. At any rate, the 2nd respondent shall pass the necessary orders within a period of four (04) weeks from the date of receipt of this order. 6. With the above, these writ petitions are disposed of. No costs. 7. Pending miscellaneous petitions, if any, shall stand closed. ___________________ JUSTICE HARINATH.N BV
